Strategic Noncompliance as a Path to Power

Donald Trump is leveraging strategic noncompliance as a means to increase his control over the Federal government and, by extension, American society. His approach involves issuing executive orders that possess questionable legal grounding. Through these actions, Trump is essentially daring the Federal government, Congress, and the courts to challenge and overrule his directives.

Congressional and Judicial Dynamics

With the GOP in control of both the Senate and the House, there is little resistance to Trump's executive orders from within Congress. Furthermore, the courts have been populated with justices selected by the Trump administration in coordination with organizations such as Project 2025 authors, the Federalist Society, and the Judicial Crisis Network. This alignment ensures a judiciary that supports Trump's vision of a strong, and increasingly authoritarian, presidency.

Conflict with Established Legal Norms

The administration's actions to implement these executive orders frequently conflict with established practices, legal guidelines, and constitutional principles. Once the orders are issued, Trump’s administration acts swiftly and deliberately, often disregarding legal constraints. Those adversely affected by these actions typically respond through legal channels, but their efforts are often delayed, as the resulting damage occurs rapidly.

Legal Challenges and Supreme Court Appeals

While the legal process unfolds, Trump continues to advance his agenda, seeking to solidify his gains before any judicial rulings can intervene. Even if lower courts rule against him, Trump resorts to emergency appeals to the Supreme Court, where he is confident that a majority of the justices will endorse his conservative and authoritarian interpretation of presidential power.

The Ballot Box: A Critical Check

Trump is aware that electoral defeat is the primary obstacle to the realization of his and the GOP’s objectives. In response, he has ordered the federalization of the national guard and their deployment into major Democratic cities, under the pretense of making these areas “safe for ordinary citizens.” His intention is to normalize the presence of the national guard in these cities and to position them at polling places, thereby intimidating voters.

Accelerating Toward Authoritarianism

This situation is not merely the onset of authoritarian governance; it is an acceleration down that path. The metaphor suggests that, rather than preparing for a journey, the country is already speeding toward the erosion of democracy and the consolidation of authoritarian rule.
